This is a hotly debated topic every time I see it discussed in a forum. Opinions are strong on both sides. What's your opinion about sending real estate email listing flyers to all the members in the MLS until they ask to be taken off your list. Do you think it should be an "opt-in" situation, so they aren't going to get one unless they ask for them? Or, do you think it's a legitimate marketing method? Tell us what you think.

- If your listing is in my MLS, I will use that MLS to find it, as long as it meets the criteria of my buyers. If not, don't spam me. If you do, and you have an opt-out link, I'll opt out the first time. If you spam me again, I'll report you as such. If your listing is in a state outside my own, don't even bother sending it to me. You're just wasting my time and yours. Of course, I'm more concerned about my time; your time you can waste as you see fit.

- I agree with the point that after send an email with mentioning that if you want then reply back with OPT IN so that it would not go to the spam folder or delete. We also getting this type of email from realestate agent (marketing emails), I simply turn it as spam. Spam - But Legal
- Yes, definitely spam. But federal law (the CAN SPAM Act) allows unsolicited flyers to be sent. However, federal requires the sender list their physical address, full contact information, and an opt-out. The sender must also clearly identify himself and that the email is a solicitation. Federal law strictly prohibits collecting email addresses with robots or from harvested email addresses. In other words, spammers, by law, have to manually collect email addresses from public places. Fines are stiff for spammers who do not comply with the CAN SPAM Act. To report an offender visit the Federal Trade Commission (who oversees enforcement) at http://www.ftc.gov/spam/.

- My article makes my opinion clear. I don't want your new listing email flyers. I especially don't want them when you send them from states in which I don't even practice real estate.
