Real Estate Policy Manual - Discrimination & Harassment
Be Clear and Detailed - It Could Protect You When it Counts Most

By James Kimmons, About.com

Independent contractors or not, a brokerage must not give the appearance of allowing any form of discrimination or harassment by the associates.

First you must state clearly that it is illegal to discriminate in the sale or rental of real property. The example section has the list delineated for you, but check to see if it is up to date and that it complies with any extra requirements for your state.

This section also discusses harassment in the workplace, and specifically requires professional behavior in all interaction in the office or with clients/customers. We also state that accusations of discrimination or harassment will be investigated.

Be sure to change the references to the state of NM to your state.

*Note: This example from an actual policy manual is provided for reference purposes only. Your brokerage should use it for ideas and guidance, consult with your attorney, and then draft your policy manual according to your desires, the laws of your state, and your attorney's counsel.
